Terms of Service

Welcome to Qiraat. These Terms of Service ("Terms") govern your access to and use of the Qiraat mobile application (the "App") and the website at qiraat.ca (the "Website"), collectively referred to as the "Service." By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Acceptance of Terms

By creating an account, downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. User Accounts

3.1 Account Creation

To access certain features of the App, you may need to create an account. You can register using your email address or through third-party authentication providers (Google Sign-In, Apple Sign-In). You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us at contact@qiraat.ca of any unauthorized use of your account or any other breach of security.

3.3 Account Deletion

You may delete your account at any time by following the instructions on our Account Deletion page or by contacting us at contact@qiraat.ca. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

4. Content

4.1 Quran Recitations

The App provides access to audio recordings of Quran recitations performed by various reciters. These recitations are provided for personal, non-commercial use only. The Quran is the holy book of Islam, and we expect all users to treat the content with the utmost respect and reverence.

4.2 Content Availability

We strive to provide uninterrupted access to all content; however, we do not guarantee that all recitations, reciters, or features will be available at all times. Content availability may change without prior notice due to licensing, technical, or other considerations.

4.3 Downloaded Content

The App may allow you to download certain recitations for offline listening. Downloaded content is licensed to you for personal, non-commercial use only. You may not distribute, reproduce, modify, or create derivative works from downloaded content. Downloaded content may be removed from your device if your account is terminated or if the content is no longer available on the Service.

5. Intellectual Property

5.1 Our Intellectual Property

The Service, including the App, Website, and all content, features, functionality, design elements, logos, trademarks, and code, are owned by Qiraat or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

5.2 Recitation Content

Audio recitations available through the App are the intellectual property of their respective reciters and/or rights holders. We have obtained the necessary licenses or permissions to distribute this content through the App. Your use of this content is subject to these Terms and any additional conditions imposed by the rights holders.

5.3 User Content

Any content you create within the App (such as playlists, favorites lists, or profile information) remains your property. By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you.

These third-party services have their own terms and privacy policies. We are not responsible for the content, privacy practices, or terms of any third-party services.

9. Termination

9.1 Termination by You

You may stop using the Service at any time and delete your account as described in Section 3.3.

9.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause and with or without notice, including but not limited to cases where:

Upon termination, your right to use the Service will immediately cease. Any content you have downloaded for offline use may no longer be accessible. Provisions of these Terms that by their nature should survive termination shall remain in effect.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL QIRAAT, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED CANADIAN DOLLARS (CAD $100), WHICHEVER IS GREATER.

You agree to defend, indemnify, and hold harmless Qiraat and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Ontario, Canada, and you consent to the personal jurisdiction of such courts.

14. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through the courts as described in Section 13.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on the Website and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.
